Welcome to Freecount. By using our application, you agree to these Terms of Service. Please read them carefully.

1. Service Description

Freecount is a shared expense management application that allows users to:

• Create and join expense groups (trips)
• Record and track shared expenses
• Calculate balances and debts between participants
• Manage personal budgets

The service is available on Android, iOS, and web platforms.

2. Acceptance of Terms

By creating an account or using Freecount, you confirm that you:

• Are at least 13 years of age (or 16 in some EU countries)
• Accept these Terms of Service
• Accept our Privacy Policy
• Have the legal capacity to enter into binding agreements

3. Account Registration

Account Types

• Registered account: Full features with email and password
• Guest account: Limited features, can be converted later
• Social login: Via Google, Facebook, or Microsoft

Your Responsibilities

• Provide accurate and truthful information
• Keep your login credentials secure
• Notify us immediately of unauthorized access
• You are responsible for all activity under your account

4. Acceptable Use

You agree NOT to:

• Use the service for illegal purposes
• Attempt to access other users' accounts
• Interfere with or disrupt the service
• Reverse engineer or exploit the application
• Use automated systems to access the service
• Harass, abuse, or harm other users
• Upload malicious content or code

5. User Content

You retain ownership of content you create (expense descriptions, group names, etc.). By using Freecount, you grant us a license to store, display, and process this content solely to provide the service.

You are responsible for ensuring your content does not violate third-party rights or applicable laws.

6. Intellectual Property

Freecount and its original content, features, and functionality are owned by Freecount and protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works without our prior written consent.

7. Advertising

Freecount displays advertisements through Google AdMob. By using the service, you acknowledge that:

• Ads are shown to support the free service
• Ad personalization can be disabled in your device settings
• Some features may be unlocked by watching reward ads

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

• Perform maintenance with or without notice
• Modify or discontinue features
• Suspend accounts that violate these terms

9. Disclaimer of Warranties

Freecount is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Accuracy of expense calculations (users should verify)
• Continuous, uninterrupted, or error-free operation

10. Limitation of Liability

To the maximum extent permitted by applicable law, Freecount shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Disputes between users regarding expenses
• Actions taken based on expense calculations

Our total liability shall not exceed the amount you paid to use the service (if any).

11. Indemnification

You agree to indemnify and hold harmless Freecount from any claims, damages, or expenses arising from your use of the service or violation of these terms.

12. Account Termination

By You

You may delete your account at any time via Settings > Delete Account. This action is permanent and cannot be undone.

By Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Abuse the service or other users

13. Changes to Terms

We may update these terms from time to time. Significant changes will be communicated via:

• In-app notification
• Email to registered users
• Updated date on this page

Continued use after changes constitutes acceptance of the new terms.

14. Governing Law

These terms are governed by the laws of France and the European Union. Any disputes shall be resolved in French courts, without prejudice to your consumer rights under applicable local law.

15. Consumer Rights (EU)

These terms do not affect your statutory rights as a consumer under EU law, including:

• Right to cancel within 14 days for paid services
• Consumer protection guarantees
• Rights under the Digital Services Act

16. Severability

If any provision of these terms is found unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Freecount regarding the use of the service.
